King Obama Has Some Bling Smacked Off His Crown

President Barack Obama just suffered a humiliating defeat in federal court. A top federal appeals court has removed three presidential appointees from power, and invalidated all actions they’ve taken over the past twelve months.

One year ago, Obama filled three seats on the National Labor Relations Board (NLRB)–an essential power center for Obama’s labor-union allies–with recess appointments, claiming that the U.S. Senate was in recess even though the Senate was still in session.

No president in history had ever done such a thing, and Republicans and conservatives immediately denounced it as an unconstitutional power grab.

In Noel Canning v. NLRB, the U.S. Court of Appeals for D.C. Circuit held today that Obama’s three recess appointments are in fact unconstitutional. As such, the three seats on NLRB were never legally filled. Thus NLRB only had two members, while the law requires three members on the five-member Board in order to have a quorum to conduct business or issue orders.

The D.C. Circuit therefore concluded that all NLRB orders issued since these recess appointments were made are entirely void, and NLRB has no power to act at all unless and until the Senate votes to confirm Obama’s nominees.

    I was happy about this ruling. But the isn’t going to stop 0bozo and his band of merry Marxists. There’s a piece from the Examiner that says the NLRB is going to keep this crap up

    The Board respectfully disagrees with today’s decision and believes that the President’s position in the matter will ultimately be upheld. It should be noted that this order applies to only one specific case, Noel Canning, and that similar questions have been raised in more than a dozen cases pending in other courts of appeals.

    In the meantime, the Board has important work to do. The parties who come to us seek and expect careful consideration and resolution of their cases, and for that reason, we will continue to perform our statutory duties and issue decisions.

    This is not just a drop in the bucket, or an insignificant ruling my friends. This really was a swift kick in the Regime’s ass by the appeals court. I have not read the decisions yet but it is my understanding that they are real scorchers.

    This one will be appealed to SCOTUS without a doubt, but I will confidently predict that the Supremes will not take this case and will allow the appeals court ruling to stand, because it is exactly right on the Constitution.

    And for the record, yes, past Presidents have indeed made “recess appointments” that stretched the definition and intent of that process, but that doesn’t make it Constitutional. This also clearly demonstrates that it is not impossible to rein in Premier Hussein on his flagrant disregard for the Constitution.

    This is a very good, and very important decision, because it marks the first time Obama has been called on his un-Constitutional acts. Let us hope this success encourages others to take legal action as well.

    This won’t matter in the near future since the RINOs in the Republican Party are going to give citizenship to 11 million illegals, you know the people who voted illegally (many of them) to get Obama re-elected.

    So if the NLRB continues on like nothing happened, and thus violates the appeals court ruling, will that mean that those that are subject to the panels ruling can also choose to ignore the illegal findings of this now voided board?

    Obama’s actions are ruled unconstitutional – a violation of the oath he took. Therefore he should be impeached.
