Planning on splitting your company of 50 employees into 2 companies with 25 employees to avoid the $2,000 Obamacare ‘Robert’s Tax’?
Think again. If you are an employer you can not get around the Obamacare ‘Roberts Tax’.

Let’s say your an employer with 50 employees and you decide the best way to avoid the $2,000 Obamacare “Robert’s Tax” is to split up your company into 2 separate companies with 25 employees each. Great idea! The only problem is the statist attorneys who helped craft Obamacare already thought of that.

Splitting a business makes no sense. What ever you would save because of obamacare will more then be consumed by a redundant management team and infrastructure. We are already seeing a pattern of small biz quickly rolling back to 25 or less and subcontracting to other 25 or less. In other words looks like you are going to end up with a shit load of 25 or less biz to escape obamacare. We are in manufacturing so the model may be different for other commodities, but that’s certainly the trend we are seeing. Obviously this does not apply to large biz.

Government already thought about the independent contractor escape. After the adoption of Obamacare the IRS started to crack down on companies like mine that use them for large projects. It is a great arrangement for our company and the guys we use who like to work for themselves. The government has hired a ton of auditors and they are using intimidation to enforce the rules. Last audit cost me $10,000.00 to hire a forensic accountant to present our paperwork. most normal small business account staff cannot be set against the IRS auditor. By the way we were fine. Perfectly legal as we had been the last 20 years. The IRS even found us $22 dollars we missed. we haven’t used any independent contractors lately. don’t know how this is all gonna work out.
