DOJ to Colorado Family: Give Up Your Religion or Your Business

The Justice Department last week presented the Newland family of Colorado–who own Hercules Industries, a heating, ventilation and air-conditioning business–with what amounted to an ultimatum: Give up your religion or your business.

“Hercules Industries has ‘made no showing of a religious belief which requires that [it] engage in the [HVAC] business,” the Justice Department said in a formal filing in the U.S. District Court for the District of Colorado.

James Newland, Andrew Newland, Paul Newland and William NewlandIn response to the Justice Department’s argument that the Newlands can either give up practicing their religion or give up owning their business, the Alliance Defending Freedom, which is representing the family, said in a reply brief: “[T]o the extent the government is arguing that its mandate does not really burden the Newlands because they are free to abandon their jobs, their livelihoods, and their property so that others can take over Hercules and comply, this expulsion from business would be an extreme form of government burden.”

    You can expect more of this from our Government! If you are a Christian in the workplace, you can expect to be fired and you can persue a Redress of Greivance, which will cost you a fortune in attorney’s fees, and the Progressive Judge will interpret the Law as saying you have no rights because you are a Christian.

    Under the Obamacare law, businesses that have more than 50 employees must provide health insurance to their employees or face a penalty.

    No, it’s a tax. So said the Supreme Court. That would be the Chief Justice and the four liberals on the court, including the two that were appointed by Obama himself.

    I think the best argument to make in front of SCOTUS is that the ACA taxes your 1st Amendment right. I said something similar in my blog but this is just more of the same. If the Newlands are claiming and exercising their right to religious freedom, the gov’t cannot tax that. They might be able to penalize it for any number of reasons; owning a business, if it’s incorporated, etc. But…and this is important…the gov’t cannot TAX it.

    Obviously, with the ACA ruling, nothing is a slam-dunk. But I think the Newlands should couch their argument as the gov’t taxing their claim and exercise of their 1st Amendment right to religious freedom, then ask the ACLU for legal help. Then post the letter of refusal.

    Just a little icing on the cake.

This is how we say it on the street, ” The sons of bitches are trying to coerce me into giving up my company for no good damn reason except because they can. Let the mother fu**ers come and try to take it.” There. Thats alot clearer and easier for eric hardon to understand.

    The nerve of these guys. What did they think, that they were smarter and worked harder than everyone else and that the business belonged to them.

    Obama and his DOJ and Obamatax are here to make an example of you. Its time everyone understands the whole context of the “You didn’t build that” speech.

    Not only did you not build your business, but government determines if you are allowed to operate your business based on your backward belief in religion. Now get with the progressive program, abortion and sterilization for all – and you pay for it employer. What a great country we live in today.
