    I hope this fellow has the wherewithal to go to court against ABC. Don’t accept some half assed apology but rather go for the financial throat (and maybe a apology just to piss off tiny George).

    Here’s the key question during the lawsuit’s discovery: Did Brian Ross type in this to Google: “Jim Holmes Aurore CO” or did he type this???: “Jim Holmes Aurora CO Tea Party”. Get the significance of the difference? Given BR’s pitiful “reporting” through the years (he Sucks as a reporter; I was a reporter too), I’d say ( with the same assurance with which he convicted Jim Holmes and the Tea Party who really got slammed) he typed in the latter.

    To BigFurHat: great job helping build Holmes’ case against ABC. Don’t forget to help the Tea Party which was DELIBERATELY slandered/libeled.

    Holmes has a VERY good case. This is libel per se, in which damages are presumed (meaning Holmes does not have to prove any).

    Defamation (libel, in this case) only requires negligence for a non public figure. Even if Holmes was considered a public figure in a public matter, the reckless disregard for the truth (and the falsity of Ross’ claim) that Ross demonstrated is sufficient to overcome a Constitutional challenge by Ross and ABC (which is vicariously liable for Ross’ statement). Holmes also has an action for negligent infliction of emotional distress, if he is suffering physical symptoms resulting from Ross’ statement.

    Tea Party Mr. Holmes is going to be coming into a lot of money.

    It is harder for the Tea Party members as a whole to have standing to sue. Just rest assured, Mr. Holmes will be made whole. And perhaps he’ll drag this out and really humiliate ABC well past the election.
