    Unbelievable! I had heard yesterday that Roberts was positioning himself to write the majority opinion (i.e. voting with the left), so that he could properly explain the rational to conservatives.

    I don’t know if that is correct, but more details will come out to prove or disprove that theory.

    @Tim — You are correct. When social security was first passed, the gov’t was telling the people that there were trust funds and that the taxes were earmarked before collection. The appeals court found that unconstitutional. When it got to SCOTUS, the gov’t changed its tune and said it was just a tax going into the general fund. SCOTUS ruled the tax constitutional.

    This is more of the same. Nowhere in the law is the word tax used; everything is a penalty. But in front of SCOTUS, they argued it was a tax. And SCOTUS fell for it again.

    Romney had better keep his word.

    Honestly, for the past year I have seen people strolling into the hospital and trying to dictate their own care (with no medical background) in the mere anticipation of this passing. I cringe to see what it’s going to be like now. We bitterly laugh about how our hospital has turned into a weekend getaway for the Section 8 crowd. They come in with “symptoms of unknown origin”, sit through a battery of tests, order three meals a day and snacks in between from the kitchen, watch cable tv, and demand narcotic pain medication that has not been prescribed. They scream racism when we won’t pony up for such requests. And then when we do find something that needs to be addressed, they leave AMA because they don’t want us meddling in their lives. And then the state of IL refuses to pay us, so we are now $40 million in the hole.

    And that’s just BEFORE this crap sandwich passed.

    @Richard 654 — This may actually make sense. Since SCOTUS has ruled it cannot be a penalty, that must mean the tax is voluntary. So you simply don’t have to pay the tax.

    @Mr.Pinko — See my comment above about Social Security. The Obamacare law doesn’t call it a tax but that was one of the arguments in front of SCOTUS. In other words, just like the FDR admin before him, Obama’s lawyers lied to the people and told SCOTUS what they wanted to hear.

    @Mr. Pinko the government litigates argued both ways. The SCOTUS tried to get them to commit to one or the other but they just kept talking in circles.

    As per my earlier comment – All adults in America will have to have health insurance or get taxed by the government. WHETHER YOU HAVE A JOB OR NOT. This should give OWS pause.

    Also the Medicare provision that got tossed I think means that States can now choose not to participate in the stupid Obamacare Act. Congress can’t punish them by collecting Medicare and then withholding payments back to them if they don’t comply.

    Now the Democrats are the dog that caught the car. Only this may prove to be a Semi- and the Dems have it by the front bumper.

    This ruling is going to prove to be a cudgel to beat the living crap out of the Socialist this November.

    “Neither the plaintiffs in the case nor the Obama administration had argued before the court that the individual mandate was a tax. Instead, the court asked a Washington lawyer to present the argument that lawsuits against the health-care law were premature under an obscure 19th-century law, the Anti-Injunction Act, which bars suits against a tax until the tax is actually paid.”

    We’ve gone from “We have to pass the bill so you can find out what’s in it” to “We have to wait until the tax is paid before we can sue against it.”

    I wasn’t aware that it was argued both ways. I only heard the Commerce Clause argument, which makes the ruling as a tax all the more hard to believe.

    Personally, I think that there is more information yet to come out. There has to be – there’s too much speculating going on. Plus reports are changing each minute – first the tax can be ignored, next minute it can’t….

    If you think for one god damned second that Romney or this squishy congress will repeal Obamacare you’re an idiot. They won’t do it. Republicans have actually called for an individual mandate before and Romney imposed one in his own state as governor.

    So what reason would they have to repeal this? There is none. You will still vote for them regardless because in your mind, “they’re better than the democrats,” or so you believe.

    It will stand unless the people show that they will not allow it to go further. But that won’t happen. Why? Because the politicians have absolutely nothing to fear now. Do you think they fear protests and signs with slogans attached. Bullshit. Americans protest everything every damned day. Protests mean nothing. Most people see a protest and ignore it. Sometimes a protest makes it’s way into the news, but only if a riot ensues or the media wish to craft a narrative. Before politicians feared another revolution. It would mean the end of their lives. Now the very mention of revolution is taboo where it was once common, and people you once considered an ally recoil in horror at the suggestion and immediately castigate the offensive person. So apparently the spirit of the 2nd amendment is dead – merely it’s dried decaying husk remains.

    It won’t be repealed. We’re stuck with it, because we’re weak now. Political correctness has defeated this country. Congratulations liberals. You won’t see the error of your ways, but your children will…

    Well, scotus managed to pry $100 out of my wallet for the Romney campaign. I hope lots of others are doing the same. It would make me feel a little better if Mittens raised hmm… roughly 200 million working citizen/subjects x 60% said they oppose obamacare x 10 lousy bucks = 1.2 trillion. That would be a nice shot across zero’s face.

    The 16th Amendment allows the fed gov’t to tax income. It does not specify how or at what rate. I wasn’t around in 1909 when this was proposed. I’m assuming the people sorta trusted the gov’t then.

    But, my goodness, what an open-ended power to give to the gov’t. What an idiotic thing to do. And where is the provision allowing states to tax you? Local cities?

    Crazy taxes were what started this country in the first place. Will it be what ends it or what causes another civil war?

    Sorry I didn’t get back right away on this. I did some quick websurfing and found the SCOTUS arguments for March 26 – the first day for Obamacare.

    If you go to the begining of Verrilli arguments (pag 31) and type in tax in the search function you’ll see Verrilli dancing around trying to claim the Mandate is a penalty when the Justices are trying to get him to admiti its a tax.

    Here are a couple of examples.

    JUSTICE ALITO: General Verrilli, today you are arguing that the penalty is not a tax. Tomorrow you are going to be back and you will be arguing that the penalty is a tax… pg 31 – 32

    pg 49 – 50

    …JUSTICE KAGAN: The nature of the representation you made, that the only consequence is the penalty, suppose a person does not purchase insurance, a person who is obligated to do so under the statute, doesn’t do it, pays the penalty instead, and that person finds herself in a position where she is asked the question, have you ever violated any federal law, would that person have violated a federal law?
    GENERAL VERRILLI: No. Our position is that person should give the answer “no.”
    JUSTICE KAGAN: And that’s because –
    GENERAL VERRILLI: That if they don’t pay the tax, they violated a federal law.

    So, looks like I missed heard the arguments. It looks like Verrilli couldn’t keep it straight – penalty? tax?

    But if no one argued that the Mandate was a tax before the SCOTUS, then how the HELL did they rule today that it would stand under the government’s argument that it was a tax?

    I can understand the liberial justices taking what ever track they need to get the outcome they want. But WTF is wrong with Roberts that that was allowed?

You can no longer sit on your butts and expect somebody else to do your share of the heavy lifting.

    Listen up: If you’re fine with paying $695./year in 2016 and upwards of $1,000. thereafter because you couldn’t bring yourself to make a stand with the only group who has your back today; if you could’t make the time between making witty remarks on IOTW and feeling bold for engaging a progtard on a faceless blog to call your reps, go to a TP meeting or send $5. to a conservative freedom fighter, then you’re not serious about pushing this president, his admin and their ideology off a cliff.

    Without looking it up, the process is the same for impeachment of the President. House of Representatives brings the charges and the Senate acts as a jury. Only one SCOTUS Chief has been impeached, it was before the Lincoln Administration but I forget who. Might’ve been Salmon Chase, but its been a long time since I took Constitutional History.

    Obama is following the plan of Cloward & Piven, two professors at Columbia University. They outlined a plan to socialize America by overwhelming the system with government spending and entitlement demands. Obamacare is a brilliant, Machiavellian game plan to turn the United States into a socialist/Marxist state with a permanent majority that desperately needs government for survival … and can be counted on to always vote for bigger government. Why not? They have no responsibility to pay for it.
    Universal health care (Obamacare). The health care bill had very little to do with health care. It had everything to do with unionizing millions of hospital and health care workers, as well as adding 15,000 to 20,000 new IRS agents (who will join government employee unions). Obama doesn’t care that giving free health care to 30 million Americans will add trillions to the national debt. What he does care about is that it cements the dependence of those 30 million voters to Democrats and big government. Who but a socialist revolutionary would pass this reckless spending bill in the middle of a depression? Obama and his regime have created a vast and rapidly expanding constituency of voters dependent on big government; a vast privileged class of public employees who work for big government; and a government dedicated to destroying capitalism and installing themselves as socialist “rulers” by overwhelming the system.

    I just learned from FOX that Romney made passionate, unequivocal statements that obamacare will be repealed in 2013. They also said that Romney has rec’d $1MM in campaign donations since this morning. Reliable polls (you know polls, right?) still show that over 60% of Americans oppose obamacare.

    Here’s another Payne quote that seems apt:

    Just like the old adage of seeing something half empty instead of half full, many are viewing the Supreme Court’s decision on Obamacare as a purely negative outcome. Sure, I would have liked the court to rule constitutionally and in a responsible fashion. Sure, I would have preferred the court use the law to base their decision instead of failed socialist ideologies. It would have also been nice to see the court use their power for the good of the nation instead of heading it towards a path of bankruptcy and despair.
    However, in the Supreme Court’s infinite wisdom they voted to uphold the Marxists principles which Obama holds so dearly. Though many despair because of this mindless decision, I see a positive side that far outweighs the negative which seem to hang so heavily over America’s future.
    Why? The answer is simple and can be summed up in one word: Complacency. It might seem over simplistic but it actually makes sense when you think about. First, you have to ask yourselves what got General Secretary Obama elected? It was the opposite of complacency: Motivation.
    What the Democrats did in the last presidential election was motivate their base to go out and vote in droves. They got them to the polls. Through rhetoric such as hope and change they made everyone out in American feel as if they alone could make a difference just by voting for Obama. They made it feel that a vote for Obama would change the country for the better; a vote for Obama would make your life better; a vote for Obama would turn America into a true utopia. Though Obama and his failed policies could do none of this, people felt as if he do all of this and more. They were thus motivated to go out and vote.
    However, times have changed. Obama is in power and his greatest assault against American freedom and Capitalism, Obamacare, was upheld. Now I ask: where’s the motivation to Obama’s supports? They already have what they want. If, however, Obamacare was repealed, there would have been a battle cry sent out by Obama and his Himmler-esk cronies. They would have berated the Republicans, chastised the courts and made it a point that if Obama were voted out of power this November, things would go back to the way things were during former President Bush’s times. Obama would have sent the fear of God into people and made them think if Romney got into office, a Republican-driven Supreme Court would repeal civil rights, women’s suffrage and all welfare-type programs. They would have painted a picture of the future filled with despair, filled with greedy capitalistic clones of Romney economically squashing the other 99% of society.
    Instead of chanting, “Remember the Maine, down with Spain”, they would be shouting, “Remember Obamacares, throw Romney down the stairs!” (Maybe not exactly, but I just wanted it to rhyme). It would have again provoked the masses to go and cast a vote towards economic insolvency- I mean for Obama.
    Now you have to ask: who is motivated now? I can tell you. All the Republicans, members of the Tea party, the working class, people who actually pay taxes and everyone who owns any size business across the country. Now, we have the motivation. We have the battle cry. We have more a reason now to vote Obama out of office than before!
    In fact, I’d like to thank the Supreme Court for their ruling. For at this moment the tide has turned against Obama and the path to his exit from the White House has become visible. Thank you for your nearsightedness. Thank you for your demagoguery. Thank you for total disregard to the Constitution. For it is through this act of total ignorance that we Americans will take back the White House and elect a real American into office!
